WHEN A RACE BECOMES A FELONY
Virginia law treats racing on public roads as a form of reckless driving that shows willful disregard for public safety (Va. Code § 46.2-865). To prove it, prosecutors look at circumstances like the time of day, road conditions, the presence of others, and whether the driving showed an intent to race rather than ordinary carelessness. A basic charge is a Class 1 misdemeanor — up to a year in jail and a $2,500 fine.
But the charge escalates fast. If the racing causes injury through willful and wanton conduct, it becomes a Class 6 felony carrying up to five years in prison; if it results in death, the exposure jumps to one to twenty years. On top of that, a conviction typically brings a license suspension of six months to two years, and for a prearranged race, Virginia can even seize the vehicle involved.
